Terms of Service

The basics

Kelly Farm Tech is operated by Kelly Metal Working Ltd (“we”, “us”). By creating an account or using the marketplace you agree to these terms. We may update them; the date at the top shows when they last changed.

Pilot status

Kelly Farm Tech is currently in pilot. The service is provided “as is” while we develop it. We'll do our best to keep your records safe and the service available, but we cannot guarantee 100% uptime during the pilot.

Your account

You are responsible for keeping your sign-in details safe. Farm accounts during the pilot are issued by signup code from us; the marketplace is open to anyone over 18.

What you put in

You retain ownership of your farm records and marketplace listings. You grant us a licence to host, display and process that content for the purpose of providing the service to you.

You agree not to use Kelly Farm Tech to break the law, to harass other users, or to post listings that misrepresent goods or services.

The marketplace — we are a venue, not a party

The Kelly Farm Tech marketplace is a notice-board that connects buyers and sellers, who transact directly with each other. We are not a party to any sale, we never hold goods or money, we do not arrange delivery or escrow, and we take no commission on private sales. Any contract for sale is between the buyer and the seller alone.

We do not verify listings or sellers. We do not inspect goods, confirm ownership, check descriptions, prices, serial numbers or provenance, or vet the identity of buyers or sellers — even where a listing has passed our automated or manual screening. Screening reduces obvious abuse; it is not a guarantee of anything.

Buying and selling safely — your responsibility

You transact at your own risk. Before paying for anything — and especially machinery, vehicles or livestock — always inspect the goods in person, verify the seller's identity, and never send a deposit or payment to someone you have not met. Be suspicious of prices well below market value, sellers who cannot show you the item, and any pressure to pay quickly or off-platform. If a listing looks fraudulent, report it with the “Report this listing” button.

To the fullest extent permitted by law, we accept no liability for any loss arising from a transaction (or attempted transaction) between users, including fraud by another user, misrepresented or defective goods, non-delivery or non-payment. Nothing in these terms limits liability that cannot be limited under Irish or UK consumer law.

Your listings and indemnity

You are solely responsible for the content of your listings and messages, including their accuracy and your legal right to sell what you list. You agree to indemnify us against claims, losses and costs arising from your listings, your messages, or your breach of these terms.

Moderation

We may screen, hold for review, remove or decline any listing, and suspend or terminate any account, at our discretion and without liability — including where we suspect fraud, misrepresentation, illegal items or prohibited activity. We'll tell you why, and you can appeal by replying to the notification email.

Compliance records

Kelly Farm Tech helps you keep records for DAFM / DAERA compliance. Final responsibility for the accuracy of your records and your compliance with regulations remains with you.

Liability

To the extent permitted by law, we will not be liable for indirect or consequential losses arising from your use of Kelly Farm Tech. We will be liable only for losses that we directly caused, and only up to the amount you paid us in the 12 months prior to the loss (zero during the free pilot).

Ending your account

You can ask us to close your account at any time by emailing hello@kellyfarmtech.com. We can suspend or close accounts that breach these terms.

Governing law

These terms are governed by the laws of the Republic of Ireland. Disputes are subject to the exclusive jurisdiction of the Irish courts.
